A panel of five judges stated that Triple Talaq “is not integral to religious practice and violates constitutional morality”. The Five Judge And Their Decision

From May 12 to May 18, five judges namely, Chief Justice Jagdish Singh Khehar, Justice Uday Umesh Lalit, Justice Kurian Joseph, Justice Rohinton Fali Nariman and Justice S Abdul Nazeer heard the case. Two of the five judges were with the view, while the act of triple talaq “may be sinful”, the court can’t interfere in personal laws and these laws are recognized as a fundamental right by the constitution.

During the arguments, the All India Muslim Personal Law Board illustrated this divorce act as “sinful”, “horrendous”, and “undesirable” with no permit of the Quran and the Shariat.
The government of India declared triple talaq an illegal, offensive and unjust practice for women. But the government had mentioned that the court should first declare its decision on the constitutional validity of this practice, only after that it would bring a law.

While Chief Justice J S Khehar and Justice S Abdul Nazeer prefer to put this issue on hold for six months and asking the government to bring a law in this regard, Justices Kurian Joseph, R F Nariman and U U Lalit declared it as volatile of the Constitution.

All India Muslim Personal Law Board Future Step

As per an official report, All India Muslim Personal Law Board (AIMPLB) has decided to make its future course of action as per the verdict of the Supreme Court on triple talaq in its working committee meeting that is scheduled on September 10 in Bhopal.

Member of the Board’s working committee Zafaryab Jilani said, “The working committee meeting in Bhopal on September 10 will take a decision on the future course of action on today’s Supreme Court verdict after studying it in detail,”
